The AMF Bowling Pinbusters Tournament (the “Program”), brought to you by Nokia Corporation, Espoo, Finland, (the “Sponsor”) will be governed by these rules (the “Official Rules”). In order to be eligible to participate you must be at least 18 years of age or of the legal age in your country of residence and a registered member of N-Gage (the “N-Gage”).; You will need an N-Gage compatible device (“Game Deck”) and own an installed full version copy of the N-Gage game, AMF Bowling Pinbusters [Game] to be able to participate in the Program. N-Gage services (such as uploading of rankings) are network-dependent and require network support. In order to be able to use these services, you must ensure that your service provider supports data traffic delivery (GPRS) and that you have subscribed to a GPRS service or your N-Gage compatible device has WLAN support and you have access to such a WLAN network or signal. Some networks have limitations that may affect your ability to use the services. Check with your mobile service provider for more information. The Program is open to participants/contestants (“Participants”) world-wide.

Sponsor, its subsidiaries, affiliates and agents reserve the right, at any time, to verify eligibility requirements, in any manner it deems appropriate. Employees and directors of Sponsor and its licensees, advertising, promotion or production agencies and provider companies (and their respective IRS dependents, immediate family members (spouse, children, parents, siblings) and individuals residing in their same household) are not eligible to participate. By participating Participants agree to these Official Rules and the decisions of the judges which are final and binding in all matters relating to this Program.

The Program is void wherever prohibited or restricted by any mandatory national, state or other government laws in a form and language as provided herein and is subject to all applicable mandatory federal (national), state and local laws.

The Program begins on July 1st, 2009, and ends on July 31st, 2009 11:59 p.m. PST (the “Program Period”). The www.n-gage.com(the “Site”) is the official time keeping device for the Program Period.

The Program will allow N-Gage Players who create an N-Gage Player Name, and register for the tournament, to simply play AMF Bowling Pinbusters on their N-Gage compatible device and upload at least one Bowling Average (with a minimum of 18-games played) to the N-Gage Arena anytime before the end of July 31^st, 2009. The winner of the tournament, and the Grand Prize, will be determined at the end of the program period.

To participate in the Program participants must have an active N-Gage Player Name. To register for an N-Gage Player Name, go to http://www.n-gage.com, click on “Create a Player Name” in the upper right corner of the website, and follow the instructions. Player can also create a N-Gage Player Name through the N-Gage application.

Once a N-Gage Player Name is created and the player has registered for the tournament, they can simply play the full version of the N-Gage game, AMF Bowling Pinbusters on an N-Gage compatible device and upload at least one bowling average (with minimum of 18-games played) to the N-Gage Arena anytime before the end of July 31st, 2009. The player with the highest bowling average at the end of the tournament time frame will win the grand prize. Any 1st place ties at the end of the tournament time frame will be decided by the N-Gage event team, and be based on the other available AMF Bowling Pinbusters game stats uploaded by the players involved in the tie. All N-Gage event team decisions are final and binding.

In order to access the Web Site, you must have access to the World Wide Web (internet) provided by an Internet Service Provider (“ISP”) of your choosing and you must pay any applicable ISP, operator, service and other fees for such access. Any registration that, in the sole discretion of Sponsor, is considered inappropriate or unsuitable for publication will be deemed ineligible by Sponsor. Sponsor reserves the right to invalidate all registrations in any manner it deems appropriate. Registrations that are found to be irregular (as solely determined by the Sponsor) will cause those registrations to be deemed void and the Participant to be disqualified.

Sponsor respects the privacy of its customers and the information submitted by you will only be used by Sponsor, in accordance with applicable data protection regulations and the privacy policy http://www.n-gage.com/ngi/ngage/web/g0/en/footer/privacy_policy.html (the “Privacy Policy”) and  the N-Gage Account Terms http://www.n-gage.com/ngi/ngage/web/g0/en/footer/account_terms.html (the “Account Terms”). Please consult the Privacy Policy and the Account Terms for more details on how Sponsor handles information submitted by you (“Personal Information”).

The top bowling  in the tournament will win the following Grand Prize:

** Trip for 2 to the 2009 QubicaAMF Bowling World Cup held in Melaka, Malaysia the 14th to the 20th of November, 2009.

- Round Trip airfare for 2
- 6 nights hotel
- Admittance to opening ceremony of event
- Premier Seats for final Matches
- $500 spending money
- Site seeing excursions with athletes
- 2 High End Bowling Ball, Shoes, and Bag Combinations (bowling ball will be custom fitted and drilled by a professional at the World Cup)

note: all players who register and participate will earn an extra 500 N-Gage points for competing in the tournament.

Taxes, if any, related to the Prize(s), and/or your ability to travel outside the country, are the sole responsibility of the winner.

The Prize(s) cannot be assigned, transferred, redeemed for cash, or substituted except by Sponsor who may, at its sole discretion, substitute any Prize with one of comparable value if the advertised Prize becomes unavailable for any reason.

Winners will be notified by email provided in their N-Gage account, or via the message board private message system at http://forums.arena.n-gage.com by August 5th, 2009 to the email address and/or player name (if private message is sent) by winner upon registration as a member of N-Gage. Winner must respond with his/her preferred mailing address by August 10^th, 2009, failing which the winner shall forfeit the Prize. In the event of such forfeiture, Sponsor shall select another winner based on the selection criteria above or dispose of the Prize in any way it deems fit. Some or all of the Prize shall be delivered to the winner at the address provided by the winner when contacted. Such delivery may be by courier service, postal service or other means as determined solely by Sponsor. Sponsor shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) in the delivery of the Prize to the winner.

Participation constitutes consent (a) to comply with these Official Rules, the Account Terms and the Privacy Policy, and (b) that Participant release and hold harmless Sponsor,  ZeniMax Media Inc., Vir2L Studios LLC, and each of their subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents from any and all liability or any injuries, including death, loss or damage of any kind arising in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in the Program or any Program related activities. If a winner is found to be ineligible or not in compliance with these Official Rules the winner’s Prize will be forfeited and an alternate winner selected. 

By submitting, and upon such submission of, any information or materials such as (but not limited to) feedback, data, text, software, music, sound, photographs, likeness, graphics, video, messages, voice, answers, questions, comments, suggestions, scores, hints, strategies, concepts, designs, ideas, plans, orders, requests or the like, or any other material (the "Content") to Sponsor or through the Site, for example, by e-mail, SMS, and/or MMS, you license and grant to Sponsor a non-exclusive, royalty-free and free of charge, perpetual, worldwide, irrevocable, and fully sub-licensable right to use, reproduce, copy, modify, adapt, communicate to the public, make available, publish, translate, create derivative works of, distribute, and display such Content or any concept described in it throughout the world in any media, product and/service, including, without limitation game decks, games, consoles, wireless devices, mobile phones and any related products, services and accessories, advertising, marketing and promotional materials, and digital reproductions, without compensation, restrictions on use, acknowledgment of source, accountability or liability, and with waiver of all moral rights and rights of attribution, integrity and identity to the extent permitted by mandatory laws.

With regard to such Content submissions, you understand and agree that you are solely and fully responsible for any and all aspects of the Content submitted, including but not limited to its legality, appropriateness and non-infringement of third party intellectual property rights, and Sponsor shall not be liable in any way for such Content. Sponsor shall have no obligation to monitor any of the Content provided by you to Sponsor, but may do so at its discretion.

Sponsor may expect the winner of the Program to appear in promotional events promoting Sponsor products in connection with, but not limited to, road shows, trade shows and consumer fairs. Any appearance made by the winner will be subject to a separate agreement made between Sponsor and the winner.

Neither Sponsor, ZeniMax Media Inc., Vir2L Studios LLC,  nor any of their subsidiaries, affiliates or agencies are responsible for lost, late, misdirected, unintelligible, interrupted or unavailable satellite, network, server, ISP, website, telephone or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture any such information. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. None of Sponsor, ZeniMax Media Inc. or Vir2L Studios LLC is responsible for injury or damage to Participants' or to any other person's computer related to or resulting from participating in the Program or downloading materials from or use of the website. Should any portion of the Program be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Program, and select the winner from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of the Site or other applicable sites.

These Program Rules are governed by the laws of Finland.

To the maximum extent permitted by applicable law, Sponsor reserves the right at its sole discretion to amend, withdraw or revise these Official Rules and the Prizes at any time without notice and in such event Sponsor shall not have any liability whatsoever.

You acknowledge and agree that you must conduct yourself in a mature and decent manner to other Participants, chat room spectators, and Sponsor. You acknowledge and agree that Sponsor is permitted to automatically disqualify any Participant that is acting in an unreasonable manner (to be determined in the sole and absolute discretion of Sponsor on a case by case basis).

You acknowledge and agree that no form of cheating will be tolerated. Any persons found cheating, as determined in the sole and absolute discretion of Sponsor, will immediately be disqualified from the Program. Cheating includes, but is not limited to, tampering, hacking of website, playing the Program without meeting the eligibility requirements, using any automated software or device to gain an advantage during the Program, using any cheat codes, exploiting any software bugs, use of the Program beyond the defined rules of the Program, attempting to disable or overwhelm any of the Sponsor sites, attempts to disrupt any portion of the Program, including, but not limited to, allowing somebody else use your Personal Information tampering with entry process or operation of promotion or website.

You acknowledge and agree that all disputes in relation to the [Game], including but not limited to, scoring, placing, eligibility, cheating, advancement and any other issue related to the AMF Bowling Pinbusters Tournament shall be determined in the sole and absolute discretion of Sponsor, and that such a decision by the Site operators or event officials shall be final and binding.

You acknowledge and agree that the AMF Bowling Pinbusters Tournament is one of skill not chance, and that you have little chance of winning without acquiring the skill to play the [Game] and master the complex controls required to play. You further acknowledge and agree that because your opposition will be other Participants, your ability to succeed in the tournament will be based purely on your skill versus that of your opponents.
